Terms of Service
IMPORTANT NOTICE: BY ACCESSING, REGISTERING ON, OR OTHERWISE USING THE EDUXIGN PLATFORM IN ANY CAPACITY, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS OF SERVICE AND ALL POLICIES INCORPORATED HEREIN, INCLUDING OUR PRIVACY POLICY. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST IMMEDIATELY DISCONTINUE USE OF THE PLATFORM.
1. Definitions
For the purposes of these Terms of Service, the following terms shall have the meanings set out below:
- “Platform” means the Eduxign website (www.eduxign.com), its mobile application, and all associated services, tools, and features operated by Vinxign Media Private Limited.
- “Terms” or “Terms of Service” means this document, together with all policies, guidelines, and notices incorporated by reference, as amended from time to time.
- “Company”, “We”, “Us”, or “Our” refers to Vinxign Media Private Limited, the registered owner and operator of Eduxign.
- “User”, “You”, or “Your” refers to any individual or entity accessing or using the Platform, including Students, Parents, Teachers, Schools, NGOs, and Institutional Partners.
- “Account” means the registered profile created by or on behalf of a User to access the Platform.
- “Content” means all video lessons, notes, assessments, quizzes, practice tests, graphics, curricula, certifications, AI-generated outputs, and other educational materials available on the Platform.
- “Subscription” means a paid plan granting a user access to designated features of the Platform for a defined period.
- “Intellectual Property” means all trademarks, copyrights, patents, trade secrets, proprietary methodologies, brand names, logos, software, course structures, and learning frameworks owned by or licensed to the Company.
- “Minor” means any individual below the age of 18 years.
- “DPDP Act” means the Digital Personal Data Protection Act, 2023, as amended.
- “Force Majeure Event” means any event beyond the reasonable control of a party, including natural disasters, governmental actions, internet outages, cyberattacks, pandemics, or acts of God.
2. Acceptance and Modification of Terms
2.1 These Terms constitute a legally binding agreement between You and Vinxign Media Private Limited. Your access to or use of the Platform in any manner — including browsing, registering, purchasing, or uploading Content — constitutes full and unconditional acceptance of these Terms.
2.2 If You are accepting these Terms on behalf of a minor, school, NGO, or other entity, you represent and warrant that You have the legal authority to bind such person or entity to these Terms, and that such person or entity agrees to be bound accordingly.
2.3 The Company reserves the right to modify, update, or replace these Terms at any time at its sole discretion. Amendments will be published on the Platform with a revised effective date. Continued use of the Platform after such publication constitutes Your acceptance of the revised Terms.
2.4 The Company may also publish supplemental terms, policies, or guidelines (including a Privacy Policy, Refund Policy, and Cookie Policy) which are incorporated into these Terms by reference. In the event of any conflict, the supplemental terms shall prevail with respect to the subject matter they govern.
3. Eligibility
3.1 The Platform is available to Students (including Minors with verifiable parental or guardian consent), Parents and legal guardians, Teachers and educators, Schools and educational institutions, Non-Governmental Organisations (NGOs), and other institutional partners.
3.2 To use the Platform, You must: (a) be at least 18 years of age, or if under 18, have the consent and active supervision of a parent or legal guardian who accepts these Terms on Your behalf; (b) have the legal capacity to enter into binding contracts under Indian law; and (c) not be a person barred from using the Platform under any applicable law or pursuant to a prior suspension or termination by the Company.
3.3 The Company reserves the right to refuse access to or registration on the Platform to any person or entity at its sole discretion, without assigning any reason.
4. Account Registration and Security
4.1 To access certain features of the Platform, you must register and create an Account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary to keep it accurate.
4.2 Each User is permitted to maintain only one (1) registered Account. The creation of duplicate or multiple Accounts for the same individual is strictly prohibited and may result in the suspension or permanent termination of all associated Accounts.
4.3 You are solely and exclusively responsible for: (a) maintaining the strict confidentiality of Your Account credentials; (b) all activities, transactions, and interactions that occur under Your Account; and (c) any and all consequences arising from the misuse of Your Account credentials.
4.4 You must notify the Company immediately upon becoming aware of any actual or suspected unauthorised access to, or use of, Your Account. The Company shall not be liable for any loss or damage arising from Your failure to maintain the confidentiality of Your credentials.
4.5 Accounts created for Minors must be linked to a verified parent or legal guardian Account. The parent or guardian assumes full and unconditional legal responsibility for the Minor's use of the Platform, including compliance with these Terms.
4.6 The Company reserves the right to require You to change Your password or take other security measures if it reasonably suspects that the security of Your Account has been compromised.
5. Nature and Scope of the Service
5.1 Eduxign is an online educational technology platform providing supplementary learning content and tools, including academic courses, school curriculum support, examination preparation materials, skill development programmes, learning assessments, certifications, and accessibility-focused education for deaf and hard-of-hearing learners.
5.2 The Company does not operate as, nor does it represent itself to be, a recognised school, college, university, degree-granting institution, educational board, or body affiliated with any regulatory authority under the University Grants Commission Act, 1956 or any other applicable statute.
5.3 Certificates issued by Eduxign are course completion certificates only. They do not confer any academic degree, formal diploma, or qualification unless explicitly and specifically stated in writing by the Company in relation to a particular programme.
5.4 The Platform may include artificial intelligence-powered features providing personalised learning suggestions, accessibility support, and learning assistance. All AI-generated outputs are informational in nature only and shall not be construed as professional, academic, medical, legal, or any other form of expert advice.
5.5 The Company reserves the right to add, modify, suspend, or discontinue any feature, tool, or service offered on the Platform at any time, with or without notice, and shall not be liable to You or any third party for any such action.
6. User Obligations and Conduct
6.1 General Obligations
By using the Platform, you agree to use it solely for lawful educational purposes; provide accurate information; respect intellectual property and privacy rights; comply with published guidelines; and ensure uploaded content does not violate applicable law or third-party rights.
6.2 Prohibited Conduct
You shall not, under any circumstances:
- Use the Platform for unlawful, fraudulent, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable purposes
- Share, transfer, sell, or otherwise make Your Account available to any other person
- Copy, reproduce, distribute, or create derivative works from Content without prior written consent
- Attempt to download, record, or permanently store video or audio Content through unauthorised means
- Reverse engineer, decompile, or tamper with Platform software or security measures
- Use automated bots, scrapers, or crawlers to access or extract data from the Platform
- Upload malware or interfere with Platform operation
- Impersonate any person or entity, or send unsolicited communications
- Attempt to access restricted areas without authorisation
7. Subscriptions and Payments
7.1 The Company offers Monthly, Quarterly, and Annual Subscription plans, as well as Individual, Family, School, and Institutional access options. Current plans, features, and pricing are detailed on www.eduxign.com.
7.2 By purchasing a Subscription or any paid feature, you agree to pay all applicable fees in full and in advance. Failure to pay fees when due may result in suspension or termination of access.
7.3 Payments are processed through Razorpay and/or other authorised third-party payment gateway providers. The Company does not directly collect, store, or process any payment card details.
7.4 All fees are exclusive of applicable Goods and Services Tax (GST) and other statutory levies, which shall be charged separately in accordance with applicable Indian law.
7.5 Given the digital and immediately accessible nature of Content, all Subscription fees and course purchase amounts are strictly non-refundable once access has been granted, except for verified duplicate payments, documented technical failures solely attributable to the Company, or where applicable Indian law mandates a refund. Refund requests must be submitted in writing within seven (7) calendar days of the original payment date.
8. Intellectual Property Rights
8.1 All Content on the Platform, and all Intellectual Property rights therein, are the exclusive property of Vinxign Media Private Limited and are protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable laws.
8.2 Subject to Your full compliance with these Terms, the Company grants You a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable licence to access and use the Content solely for Your own personal, non-commercial educational purposes during the term of Your active Subscription or access period.
8.3 This licence does not permit reproduction, redistribution, commercial use, or removal of proprietary notices. Any proprietary sign language methodology, educational framework, AI model, or learning approach developed by the Company constitutes trade secrets of Vinxign Media Private Limited.
8.4 If You believe that any Content on the Platform infringes Your intellectual property rights, please notify the Company in writing at the contact address provided in Clause 16.
9. Child Safety and Minor Users
9.1 The Company is committed to the safety and protection of Minor users and complies with the DPDP Act and all other applicable laws governing the processing of personal data of Minors.
9.2 Accounts for Minors must be created and managed by a verified parent or legal guardian who accepts these Terms and consents to data processing as described in the Privacy Policy.
9.3 The Company does not knowingly collect personal data from Minors without verifiable parental consent. If the Company becomes aware that a Minor has registered without such consent, it shall take immediate steps to delete the Account and associated data.
9.4 Parents and guardians are responsible for supervising their child's use of the Platform. Parents may request access to, correction of, or deletion of a Minor's personal data through the contact mechanism described in Clause 16.
10. Data Privacy and User Data Rights
10.1 The Company collects and processes personal data including identity data (name, date of birth, gender), contact data (email address, phone number), educational data (class, school, performance), technical data (device information, IP address, browser information), learning data (progress, assessments, watch time, course activity), and payment data (transaction references and subscription details). The Company does not store payment card details directly.
10.2 All personal data is collected, stored, and processed in accordance with the DPDP Act and the Company's Privacy Policy, available at www.eduxign.com/privacy.
10.3 You have the right to request access to and correction of personal data, request permanent deletion (subject to legal retention exceptions), and withdraw consent where processing is consent-based. Deletion is irreversible and will result in loss of Account access, learning history, certificates, and associated Content.
10.4 The Company implements appropriate technical and organisational measures to protect personal data. However, no transmission of data over the internet can be guaranteed to be completely secure.
11. User-Generated Content
11.1 Certain categories of Users, including Teachers, may upload or submit content to the Platform (“User Content”). By submitting User Content, you represent that you own or have necessary rights and that the content complies with these Terms and applicable laws.
11.2 By submitting User Content, you grant the Company a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and sublicensable licence to use such User Content in connection with the operation and improvement of the Platform.
11.3 The Company reserves the right to review, moderate, remove, or refuse to publish any User Content at its sole discretion. You shall indemnify the Company against claims arising from User Content you submit.
12. Institutional and NGO Partnerships
12.1 Schools, educational institutions, NGOs, and government bodies may engage with the Platform through partnership models including Bulk Licensing, Coupon Distribution, Sponsored Education Programmes, and Government Education Programmes.
12.2 Each such arrangement shall be governed by a separate written agreement — including a School Agreement, NGO Agreement, Organisation Partnership Agreement, or Government Memorandum of Understanding (MoU), as applicable. These Terms shall apply unless expressly superseded by the relevant partnership agreement.
12.3 Institutional partners are responsible for ensuring that all Users they enrol comply with these Terms and shall be jointly and severally liable for breaches by Users they have enrolled.
13. Account Suspension and Termination
13.1 The Company reserves the right to suspend, restrict, or permanently terminate Your Account, with or without prior notice, for breach of these Terms, fraudulent or harmful conduct, payment failure, false information, or any conduct harmful to the Platform or other Users.
13.2 Upon suspension or termination, Your right to access the Platform and all Content will immediately cease. Unused Subscription fees may not be refunded in cases of termination due to breach.
13.3 You may request voluntary Account deletion at any time. Certain data may be retained as required by applicable law. Voluntary deletion is irreversible.
13.4 Provisions that by their nature should survive termination shall continue in full force, including Intellectual Property, Data Privacy, Disclaimers, and Dispute Resolution clauses.
14. Disclaimers and Limitation of Liability
14.1 The Platform and all Content are provided on an “as is” and “as available” basis, without any warranty of any kind, express or implied.
14.2 To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenue, data, goodwill, or opportunity.
14.3 The Company's aggregate liability to You for all claims shall not exceed the total Subscription fees paid by You in the three (3) calendar months immediately preceding the event giving rise to the claim.
14.4 The Company shall not be liable for any failure or delay arising from a Force Majeure Event. Nothing in these Terms shall limit liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable Indian law.
15. Third-Party Services and Links
15.1 The Platform may integrate with or link to third-party services, including payment gateways, analytics providers, and communication tools. The Company does not endorse or accept responsibility for third-party content, practices, or policies.
15.2 Your use of any third-party service is at Your own risk and subject to the respective terms and privacy policies of such providers.

For data-related requests, including access, correction, deletion, or withdrawal of consent, please use the grievance mechanism available on the Platform.
17. Governing Law and Dispute Resolution
17.1 These Terms shall be governed by and construed exclusively in accordance with the laws of India.
17.2 Any Dispute shall first be resolved through good-faith negotiation within thirty (30) calendar days of written notice.
17.3 If unresolved, the Dispute shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Raipur, Chhattisgarh, India. Proceedings shall be conducted in English.
17.4 Subject to arbitration, the parties submit to the exclusive jurisdiction of the courts located at Raipur, Chhattisgarh, India for enforcement of arbitral awards or interim relief.
18. General Provisions
18.1 Entire Agreement: These Terms, together with the Privacy Policy and incorporated policies, constitute the entire agreement between You and the Company.
18.2 Severability: If any provision is held invalid, the remaining provisions shall continue in full force.
18.3 Waiver: No failure to exercise any right shall operate as a waiver thereof.
18.4 Assignment: You may not assign Your rights without prior written consent. The Company may assign its rights to any affiliate, successor, or acquirer.
18.5 Notices shall be in writing. Notices to You shall be sent to the email address registered on Your Account.
18.6 These Terms are drafted in English. In the event of any translation, the English version shall prevail.
18.7 Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between You and the Company.
By using the Eduxign Platform, you confirm that you have read, fully understood, and voluntarily agree to be bound by these Terms of Service in their entirety.
